Privacy Policy

Effective: June 27, 2026 · includes our Cookie Policy · arch.music
Plain-language summary: when you enter one of our contests, votes, giveaways, presaves, or sign up for fan updates, we collect your phone, name, and email so we can enter you, verify you, run the promotion, and (with your consent) send you updates from the artists. If you win a physical prize, we collect a shipping address. We never sell your data. We use first-party data to run our sites and, where you allow it, the Meta Pixel and Meta Conversions API to measure our ads. One word (STOP) or one click (unsubscribe) ends marketing texts/emails anytime; rejecting optional cookies stops optional browser-side ad tracking.

1. Who's responsible for your data

The data controller is Butr Inc. (Québec enterprise no. 1174469701, Montréal, Québec, Canada), operating these promotions for the artists ARCH, Nico de Andrea, and partners we work with. For any privacy request — access, correction, deletion, or to reach our Privacy Officer — write to support@arch.music. We respond within 30 days.

2. What we collect, and why

This policy covers every contest, vote, giveaway, sweepstakes, presave campaign, and fan-signup we run from time to time across our arch.music sites. The exact fields collected vary by promotion, but they fall into these categories:

DataWhenWhy
Phone numberOn entry / signupTo verify you (one-time code), enter you in the promotion, and — only with your consent — send marketing texts
NameOn entry / signupTo identify entrants, contact winners, and personalize messages
Email addressOn entry / signupTo confirm your entry, contact you about the promotion, and — only with your consent — send marketing emails
Shipping addressOnly if you win a physical prizeTo deliver the prize
Contest actions you completeDuring a promotionTo award entries (e.g. saving a track, following, voting, sharing) and prevent fraud/duplicates
Technical data (IP, device/browser, referrer)When you use the siteSecurity, fraud prevention, and basic site operation
Ad-measurement data (see §7)Where you allow itTo measure which ads led to entries

3. Legal basis (GDPR / UK GDPR)

If you're in the EEA or UK, we rely on:

4. Consent — texts & emails

We only send marketing messages to people who opt in. Each promotion records the consent you gave, when, and for what channel. Marketing consent is always optional and separate from entering — you can enter a contest without agreeing to ongoing marketing.

Ending marketing does not remove you from a promotion you already entered, and we may still send you essential service messages about that promotion (e.g. that you won).

5. Who we share it with

We do not sell your personal information. We share it only with service providers who help us run promotions, under contract and only for that purpose:

We may also disclose data if required by law, or to protect our rights, safety, or the integrity of a promotion.

6. International transfers

We're based in Canada and use providers in the United States and elsewhere, so your data may be processed outside your country. For transfers out of the EEA/UK, we rely on the European Commission's Standard Contractual Clauses (and the UK Addendum) with our providers, plus their own safeguards. Canada is recognized by the EU as providing adequate protection for commercial data.

7. Cookies, the Meta Pixel & ad measurement

Our sites use a small number of essential first-party cookies/local storage to run the site, remember your entry progress, and prevent fraud. These are always on because the site can't function without them.

Where enabled for a promotion, and subject to your consent where the law requires it, we also use:

You can reject optional cookies to stop browser-side Pixel tracking, control ad tracking in your device/browser settings, and adjust your Meta ad preferences in your Meta account. We honour Global Privacy Control (GPC) signals where applicable.

Correction note: earlier versions of this policy described our sites as "tracker-free." That is no longer accurate now that we measure ad performance with the Meta Pixel/CAPI as described above. This section reflects what we actually do.

8. How long we keep it

We keep promotion entry data for as long as needed to run the promotion, confirm winners, fulfil prizes, and meet legal/record-keeping obligations (typically up to 24 months after a promotion ends), then delete or anonymize it. Marketing contacts are kept until you opt out, after which we keep a minimal suppression record so we don't message you again. Consent logs are kept as proof of compliance.

9. Your rights

Depending on where you live (GDPR/UK GDPR, Québec Law 25, Canada PIPEDA, and similar laws), you can ask us to:

To exercise any right, email support@arch.music. EEA/UK users may also complain to their local data-protection authority; Québec users may contact the Commission d'accès à l'information du Québec.

10. Children

Our promotions are intended for adults 18 and older and are not directed to minors. We do not knowingly collect data from anyone under 18. If you believe a minor has given us data, email support@arch.music and we'll delete it.

11. Security

We use industry-standard measures (encryption in transit, access controls, hashing of identifiers shared for measurement) to protect your data. No system is perfectly secure, but we take reasonable steps and will notify you and regulators of a breach where the law requires.

12. Changes

We may update this policy as our promotions and tools change. We'll post the new effective date here, and for material changes affecting marketing, we'll ask for fresh consent where required.
